2. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information to our DMCA Agent:

  • Your physical or electronic signature;
  • Identification of the content that has been removed or to which access has been disabled, and the location at which the content appeared before it was removed or access was disabled (URL);
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification;
  • Your name, address, telephone number, and email address;
  • A statement that you consent to the jurisdiction of the federal court in your district (or, if you are outside the U.S., to the jurisdiction of a U.S. federal court located in [Insert Jurisdiction, e.g., California]), and that you will accept service of process from the person who provided the original DMCA takedown notice or their agent.

After we receive a valid counter-notification, we will forward it to the original complainant. If they do not file a lawsuit within 10 business days, we may restore the removed content.


3. Repeat Infringers

In accordance with the DMCA and other applicable laws, Roowins.com maintains a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.


4. Good Faith and Abuse Policy

Submitting false DMCA notices or counter-notices can result in legal liability. All parties must act in good faith. Misuse of this process may lead to civil penalties under Section 512(f) of the DMCA.
